POWERS OF ATTORNEY
A power of attorney allows you to choose someone who will make decisions on your behalf, under certain circumstances.
There are two types of powers of attorney in Ontario. One for personal care and one for property.
By executing a power of attorney you are giving another person legal authority to act on your behalf. Therefore, it is important to appoint someone you trust, noting that you do not have to choose the same person for both property and personal care.
Types Of Powers Of Attorney
A continuing power of attorney gives a person the authority to make financial decisions in your stead. This document takes effect as soon as it is signed, unless otherwise stated. You can limit the scope of the donee's authority or it can be left quite broad.
A power of attorney for personal care gives a person authority to make decisions surrounding your personal care. This can include health care, housing, nutrition and consent to medical treatment. This document only takes effect when you are no longer capable of making these decisions on your own.
