Cook Law is pleased to represent both lenders and borrowers in a wide range of mortgage transactions, including new mortgage registrations, mortgage refinancing, home equity lines of credit (HELOCs), private financing, and second and third mortgages.
Current Refinancing Landscape
Canada is approaching a significant wave of mortgage renewals, with an estimated 60% of Canadian mortgages set to come up for renewal in 2026 and 2027.
If your mortgage is coming up for renewal, an important question to consider is: Do you want your refinance handled as just another file, or do you want a legal team that protects your interests and recognizes the investment that you have made in your home?
At Cook Law, we believe that every refinancing transaction deserves careful attention, clear communication, and legal guidance tailored to the needs of the client.
What value can we bring to you?
As exeprienced legal professionals in mortgage refinancing, we understand the competing interests and priorities of everyone involved in a transaction. Lenders value efficiency and security. Mortgage brokers seek smooth, timely closings. Borrowers want protection, clear explanations, and confidence that their interests are being properly addressed.
Cook Law is committed to delivering exceptional client service at every stage of the refinancing process. We keep our clients informed of their transaction's progress from start to finish, ensuring they understand what is required and what to expect along the way.
Our Guarantee: Our lawyers remain personally involved through each stage of a transaction.
Rather than leaving files to be handled exclusively by support staff, our lawyers oversee the work at every stage and remain available to address questions and concerns as they arise. Our goal is to provide a responsive, transparent, and dependable legal experience, with fewer surprises along the way.
What type of legal services can you expect?
For each refinancing transaction, our lawyers will:
- Conduct the necessary searches and due diligence, including title and Personal Property Security Act (PPSA) searches, to identify registrations, encumbrances, and other matters that may affect the mortgage security or the transaction.
- Coordinate the payout of existing financing from the mortgage proceeds, including obtaining payout statements and arranging for the discharge of existing mortgages and other applicable encumbrances.
- Prepare and review mortgage documentation and related legal documents to ensure the transaction is properly documented and the parties understand their respective obligations.
- Register the mortgage and any related instruments required by the lender, helping to protect the lender's security interest and ensure the transaction is completed in accordance with applicable legal requirements.
At Cook Law, we recognize that a mortgage refinance is more than a registration on title. It is a significant financial transaction that deserves careful legal attention, clear communication, and a commitment to protecting our clients' interests.
